Terms of Service
( T . O . S )Full Disclaimer/ Important information:Regarding wait times, the terms surrounding them will remain true as to what is written in the process terms section. Please be aware that the business operator struggles with chronic physical health issues and the process may require patience. In the event that the commission process may exceed the wait time stated in the process terms, the client will be asked to agree to an extended deadline and offered compensation in the form of percentage discounts ranging between 5-30% to be used on future commissions. All active clients will be notified through direct message or publicly posted updates if a physical health issue occurs that may affect wait times.1. General terms:(1a)- The client must provide clear reference images, inspiration pictures and/or otherwise when placing an order. If reference images are not of decent quality, the artist is not liable for any mistakes made in the artwork.
(1b)- For the inclusion of any weaponry, heavily detailed customised objects etc, the client must provide a malleable 3D model or accept that the item may not look true to the reference when the artwork is created.
(1c)- Respect of the terms, artist, and process is mandatory. Any disrespect, mistreatment, or otherwise negative behaviour may result in the commission process being ended by the artist with partial or zero compensation depending on the commission’s progress at the time of cancellation.
(1d)- The artist reserves the right to decline or cancel a commission at any time for any reason. Compensation may be offered in the case of cancellation depending on the commission’s progress at the time of cancellation.
(1e)- Depending on the complexity of a character design, background, composition or otherwise, surcharges may be applicable to the commission. Clients will be notified of any surcharges before payment and placement of the order is agreed upon.
(1f)- Clients must be at least 16 years of age to place an order with the artist. Clients under the age of 16 must have parental consent, proven in the form of an email from their parent/guardian or a photograph of a written and signed letter from the parent/guardian..
(1g)- Valid, in-date Identification MUST be provided if a client wishes to place an order containing graphic content, including but not limited to; gore, sexual content, nudity. Accepted forms of identification are as follows; Passport, Driver’s License, Student ID. (containing date of birth).
(1h)- The artist reserves the intellectual rights to all artworks, and otherwise, created by them. The artist is permitted to publicly post, share, and create content including/surrounding the commissioned artwork.2. Payment terms:(2a)- Payment will be issued to the artist in full and upfront, exceptions are limited to payment plans, or an agreed upon circumstance in which 50% of the payment is sent upfront- with the remaining 50% sent upon the completion of the sketch stage. If looking to, clients must request any of the aforementioned exceptions when placing their order.
(2b)- Payment plans will be applicable for orders totalling £120 or above, exceptions may be made considering the client’s personal circumstances, though the decision will be ultimately up to the artist. If they are looking to, clients must request a payment plan and provide details on how much they intend to pay and how often when placing the order.
(2c)- Payments may be made through any of the following; VGen, Ko-Fi, PayPal, Stripe, and, (for orders totalling above £200), bank transfer.
(2d)- Chargebacks and refunds (that have not been agreed upon by the artist) forced through the 3rd party site/otherwise will be subject to legal action.3. Process terms:(3a)- The artist will begin creating the commissioned artwork anywhere between 1 day and 2 weeks post the placement of the order. If requested, an estimated date of when the process will begin will be provided, though this date can be subject to change.
(3b)- The creation process (beginning the sketch/mockup through to completing the commission) may take anywhere between 2 weeks and 5 months. Wait times will vary depending on the commission’s complexity and the amount of other orders the artist is taking on at any given time.
(3c)- Clients may request that their order takes priority over other orders in the artist’s queue, at which point they will pay a surcharge of £5 (GBP) per order they have taken priority over. Clients can choose how many positions in the queue they wish to move up by.
(3d)- Clients may request a rush commission (top priority position and a fixed deadline) for a surcharge of £30 (GBP) flatrate. Deadlines set less than 1 week after the order’s placement will be subject to a surcharge of £50 (GBP) flatrate.
(3e)- The client may request small changes throughout the sketch process, or request additions for surcharges. The client may not request a large change (such as change of pose) without surcharges given that they had not provided and/or chosen a pose beforehand. Clients who have chosen specific posing before the sketch process whom feel that the artist has improperly captured the pose MAY request changes to posing free of charge. Changes regarding posing, expression, and major/medium details cannot be requested past the confirmation of the sketch stage. Very minor changes (such as small additions and minor details) may be requested between the sketch confirmation and flatcolour confirmation. Past the flatcolour confirmation, only changes that do not pertain to pre-existing components of the artwork may be requested (for example, the client may request changes to small effects used in the rendering stage).
(3f)- Regarding custom character design commissions, several major changes can be made during the sketch stage free of charge. Past the sketch confirmation, a base palette (agreed upon set of colours) will be confirmed, at which point the client is allowed to make changes to patterning, colour placements, and the inclusion of any complimentary/other colour added to the design that was not present in the base palette. Clients may request the addition of minor accessories or details free of charge past the completion of the colouring.
(3g)- Work in progress updates will be provided for all orders that are eligible for updates, the update stages are as follows; Mockup (if applicable to commission), Sketch, Linework, Flatcolour, Shading. Clients may request additional updates, or to simply view the commission’s current progress at the time of the request.
(3h)- Work in progress updates will not be applicable for the following; Any commission option including “SKEB” or “Surprise Me” in the title, sketch commissions (whether coloured or uncoloured, shaded or unshaded), any commission that the artist has stated- before purchase- will not include updates or is SKEB/Surprise Me.4. Copyright & Commercial Use:(4a)-The artist owns the full rights to any and all commissioned artworks they create. Clients who have not purchased any extended rights (such as commercial use or otherwise) have the rights to: use their commissioned work for profile pictures, banners/profile decoration on social media, share the artwork (with credit to the artist) on social media platforms, print of a physical copy of their artwork for personal use only. Clients without a commercial use agreement must not create customised physical items using the commissioned work, including but not limited to: keychains, stickers, pins, badges, book covers, apparel. If a client wishes to create anything other than a printed physical copy of the artwork with their commissioned piece, they must directly contact the artist and request permission.
(4b)- The artist reserves the rights to do all of the following; post/share the artwork to social media platforms with or without direct credit to the client, create image or video content with the commissioned artwork, create business related advertisements with the commissioned artwork, display the commissioned artwork on business and/or personal portfolios.
(4c)- Clients must not use commissioned artwork to create AI generated imagery, clients must not expose the artist’s work to any artificial intelligence, including but not limited to; ChatGPT, SoraAI, Grok, Bing Image Creator, AI chatbot services, AI image generation services, any data scraper services involved with AI image generation or any information storing related to AI generation purposes.
(4d)- Clients must not use commissioned artworks to create new and/or modified artwork- the following are prohibited: tracing the commissioned artwork, re-colouring the commissioned artwork, commissioning or requesting another artist to colour any sketch, lineart, or incomplete commission, photobashing, editing, AI generating.
(4e)- Clients must not claim that the commissioned artwork/s were created by anyone other than the artist, nor can they use the artwork for their own advertisements, portfolios, or content (unless extended rights have been purchased).
(4f)- Breach of any of the Article 4 terms is copyright infringement and will be subject to legal action.5. Refund/Cancellation Policy:(5a)- The following circumstances make the commissioned work eligible for full refund: cancellation by either party before the commission process has started.
(5b)- The following circumstances make the commissioned work eligible for partial refund: Cancellation by either party when the process has started but the artwork is not complete (eligible for 50% refund). Cancellation by either party once the sketch has been completed and before the next stage has started (20% refund). Cancellation by either party when the flat colours have been completed and the next stage has not been started (5% refund).
(5c)- The following reasons/circumstances are ineligible for refund: Cancellation by either party past the flatcolour stage. Request of refund once the artwork has been completed. Requested refund due to a client’s personal disliking of the completed artwork, or the artwork once past the flatcolour stage.
(5d)- Refunds may take an extended time to process if the funds have been directly wired to the artist. Depending on transfer times between banks and 3rd party sites, the wait times for receiving the refunded amount will vary.
(5e)- It is required that the reason for cancellation is provided to the artist before cancellation can be confirmed.
(5f)- Refunds must be agreed upon by the artist before any action is taken toward refunding a purchase. Any refunds forced through bank or 3rd party sites/apps will be subject to legal action.
